These Terms of Service (“Terms”) govern access to and use of RichBot9000 products at richbot9000.com, including the web app, APIs, voice and SMS programs, meetings, merchandise, and related services (the “Services”). By creating an account, visiting the site, or using the Services, you agree to these Terms and our Privacy Policy.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

1. The Services

RichBot 9000 is an operations platform for AI assistants, tools, scheduled bots, contacts, surveys, appointments, projects, voice calls, SMS, meetings, files, and related automation. Features may change, and some features may be limited by role, plan, or third-party provider availability.

2. Accounts

• You must provide accurate registration information, including a valid email address and phone number where requested.
• You are responsible for your credentials, API tokens, and activity under your account.
• You must be at least 13 years old, and old enough to form a binding contract where you live.
• We may require email and SMS verification before full access is granted.

3. Acceptable use

You may not use the Services to:

• Violate law, including privacy, recording-consent, TCPA, CAN-SPAM, or export rules.
• Send spam, phishing, or unsolicited marketing SMS, email, or calls.
• Contact people without a lawful basis and any required prior consent.
• Attempt unauthorized access, disrupt the Services, or probe systems you do not own.
• Upload malware, infringe intellectual property, or impersonate others.
• Use AI, voice, or messaging features to deceive, harass, or cause harm.
• Resell or scrape the Services except as we expressly allow.

We may suspend or terminate access for suspected abuse, legal risk, or non-payment.

4. AI, voice, and automation

Assistants, phone trees, cronbots, and related tools generate output from models and workflows that can be incomplete, incorrect, or unexpected. You remain responsible for reviewing outputs before you rely on them, and for any actions the Services take using credentials, tools, or integrations you enable.

Calls and meetings may be recorded, streamed, or transcribed as part of the product. You must obtain any notices and consents required for recording or automated calling in the jurisdictions of all participants.

5. SMS and messaging program

You may only send messages to recipients who have consented through a lawful opt-in. You must honor STOP, HELP, and similar commands. Consent for text messaging is not transferred to unaffiliated third parties for their own marketing. Details are in the Privacy Policy. Opt-in is also available at /notifications.

6. Your content and licenses

You retain rights to content you submit (“User Content”). You grant us a worldwide, non-exclusive license to host, process, transmit, and display User Content solely to operate, secure, and improve the Services, and to provide features you enable (including sending content to model and telephony providers).

You represent that you have all rights needed to submit User Content and to contact the people whose data you upload.

7. Third-party services

The Services may call Twilio, OpenAI, Ollama, Stripe, email providers, MCP servers, and other third parties you configure. Those services are governed by their own terms. We are not responsible for third-party outages, model behavior, or data handling beyond our instructions to those providers.

8. Merchandise and payments

Merchandise purchases are processed by Stripe. Prices, shipping, and availability may change. Except where law requires otherwise, sales are final once fulfilled. Contact support@richbot9000.com for order issues.

9. Intellectual property

The Services, branding, software, and documentation are owned by RichBot9000 or its licensors. These Terms do not grant you any right to copy, modify, or reverse engineer the platform except as allowed by law.

10. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RICHBOT9000 AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE THREE MONTHS BEFORE THE CLAIM.

12. Indemnification

You will defend and indemnify RichBot9000 against claims arising from your User Content, your communications (including SMS, email, and calls), your use of integrations, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Services at any time. We may suspend or end access if you breach these Terms or if we discontinue a product. Sections that by their nature should survive (including 6, 9–12, 14, and 15) will survive.

14. Changes

We may update these Terms by posting a new version at this URL. If a change is material, we will update the date above. Continued use after the effective date constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the State of Missouri, excluding conflict-of-law rules. Courts located in Jackson County, Missouri will have exclusive jurisdiction, except that we may seek injunctive relief in any forum. If a provision is unenforceable, the rest remains in effect.
